The dispute focused on delays related to window procurement and installation, elevator procurement, framing activities, smoke curtain installations, and deficiencies in project scheduling and management practices.



HPM Consultants conducted a detailed forensic schedule and project management analysis to evaluate the impact of procurement delays, scheduling deficiencies, subcontractor coordination issues, and critical-path activities on project completion. The review included analysis of delay notices, schedule updates, procurement records, RFIs, subcontractor buyout activities, elevator systems, smoke curtain installations, and contemporaneous project correspondence.
HPM Consultants determined that the project experienced substantial delays, primarily due to poor project management, procurement failures, delayed subcontractor coordination, and unrealistic schedule assumptions. The analysis concluded that key activities, including smoke curtain procurement and elevator-related work, became critical gating items that significantly impacted inspections, Certificate of Occupancy milestones, and overall project completion. HPM Consultants subsequently presented these findings and provided expert testimony at arbitration, offering a clear and authoritative account of the delay causation and its impact on the project timeline.
