The Challenge

HPM Consultants was retained by the contractor of a municipal building to evaluate alleged project delays associated with construction activities. The analysis focused on determining whether soil remediation delayed project completion or whether other contractor-related events were responsible for the extended completion date.

The project involved multiple concurrent construction and tenant-improvement activities that experienced numerous schedule revisions, redesigns, and added work scopes. Soil remediation impacted completion, prompting an independent forensic schedule review by HPM Consultants.

HPM Consultants conducted a forensic schedule analysis and comprehensive review of project documents, schedules, and weekly status reports. The evaluation examined critical-path impacts, delay-event timing, contractor coordination issues, and the effect of project modifications on overall completion.

The investigation identified significant delays related to staircase redesigns, MEP modifications, PEMB wall panel revisions, and tenant-improvement changes. HPM Consultants also performed a but-for critical path analysis to determine whether the project completion date would have changed without the soil remediation activities.

Outcome

HPM Consultants conducted a comprehensive forensic schedule analysis and but-for critical path evaluation to determine the true drivers of project delay. The but-for analysis demonstrated that removal of the disputed event from the schedule did not alter the project completion date, establishing that other project events controlled the critical path throughout the relevant period. The findings provided a clear, fact-based conclusion supported by contemporaneous project records and accepted forensic scheduling methodologies, offering the client and counsel a defensible evidentiary foundation for the dispute resolution process.
