Dolores Huerta Gardens Apartments

The Challenge

HPM Consultants was retained to evaluate delays affecting the Dolores Huerta Gardens Apartment project arising from extended Southern California Edison (SCE) lead times and additional Solar As-Built Approval requirements introduced during construction. The dispute focused on whether these events qualified as excusable delays under the contract and whether the contractor was entitled to additional time-related compensation.

Our Services

HPM Consultants conducted a detailed contract and forensic schedule review using the AIA A102 2017 and AIA A201 2017 contract provisions together with recognized industry delay-analysis methodologies. A prospective Time Impact Analysis (TIA) was performed to evaluate the impact of SCE lead-time delays and Solar As-Built Approval activities on the project’s critical path and completion date.

Outcome

HPM Consultants determined that the SCE lead-time delay impacted project completion by 89 calendar days, while the Solar As-Built Approval requirement added an additional 22 calendar days of delay. The combined excusable delays resulted in a total project impact of 111 calendar days, supporting the contractor’s entitlement to time-related compensation.
