The Challenge

HPM Consultants was retained to evaluate delay claims associated with the Lakeside Equestrian Park project, including allegations related to building permits, sewer right-of-way access, and sewer connection design. The dispute focused on whether these issues delayed project completion and whether the contractor was contractually entitled to additional time and compensation.

Our Services

HPM Consultants conducted a detailed contract and forensic schedule review to assess the validity of the contractor’s delay claims and their impact on the project’s critical path. The analysis evaluated contract notice requirements, entitlement issues, design responsibilities, and the relationship between the alleged delay events and the actual project completion date.

Outcome

HPM Consultants determined that several delay claims did not comply with contractual requirements and did not materially impact the project’s critical path or completion date. The analysis concluded that although certain design-related issues created entitlement concerns, the claimed sewer connection delays did not delay overall project completion, resulting in significantly reduced delay impacts compared to the contractor’s original claims.
